DMCA Policy

At Exlecticlocal, operated by XTBM Hong Kong Limited, we hold a profound respect for the intellectual property rights of designers, artists, and creators worldwide. As a curated platform featuring premium home goods, including our Modern Archive and Found Objects collections, we are strictly committed to maintaining a digital storefront free of infringing materials.

In compliance with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512) and other applicable international intellectual property laws, we have established the following protocols to address claims of copyright or trademark infringement.

1. Reporting Copyright Infringement (Takedown Notice)

If you are a copyright owner, or are authorized to act on behalf of one, and you believe in good faith that any product imagery, textile pattern, or unique design featured on the Exlecticlocal website infringes upon your copyrighted work, please submit a formal Notice of Claimed Infringement to our Designated Copyright Agent.

To ensure a swift and legally compliant response, your written notice must include the following information:

  • Authorization: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  • Identification of the Work: A detailed description of the copyrighted design or material that you claim has been infringed.

  • Identification of the Material: The exact URL(s) or specific product links (e.g., from our Modern Archive or Found Objects series) where the allegedly infringing material is located.

  • Contact Information: Your full legal name, mailing address, telephone number, and electronic mail address.

  • Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • Statement of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid notice, Exlecticlocal reserves the right to take expeditious action, which may include removing or disabling access to the allegedly infringing material.

2. Counter-Notice Procedure

If you believe that your content or product listing was removed by mistake or misidentification, you may submit a Counter-Notice to our Designated Copyright Agent. Your Counter-Notice must include:

  • Your physical or electronic signature.

  • Identification of the material that has been removed and the location (URL) at which the material appeared before it was removed.

  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • Your name, address, telephone number, and e-mail address.

  • A statement that you consent to the jurisdiction of the courts in Hong Kong SAR, and that you will accept service of process from the person who provided the original infringement notification.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Exlecticlocal has adopted a strict policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users, suppliers, or manufacturing partners who are deemed to be repeat infringers of intellectual property rights. We rigorously vet our supply chain to ensure all items meet original design standards.
